Defending against Foreclosure - What Are Your Options?
There are situations where the foreclosure is improper. Your lender may not have disclosed mortgage transfers to you or the proper plaintiff may not be named because the loan has been sold and reassigned so many times that the proper owner may be difficult to identify. I will investigate your situation fully, finding out what options you have to prevent you from losing your home.
If the foreclosure is proper you may qualify for one of the following:
- Mortgage modification. A modification may be readily available and allow you to get back on track and get a fresh start,
- Short sale of your property. In a short sale, you sell your property for less than you owe. If a short sale is your best option, I will not allow closing to go through unless there is a full forgiveness of the entire debt. As long as the home is your primary residence, you will not be hit with the tax burden for the forgiven loan.
